Dear Mr. Condit:

This is in response to your letter dated August 12, 1986, in which you appealed Mr. Donnie H. Grimsley's letter dated August 1, 1986, which responded to your Freedom of Information Act request for documents regarding NRC permits for disposal of radioactive material via incineration. You limited the scope of your original request to a list of all facilities authorized by NRC to incinerate radioactive material.

You specifically are appealing the completeness of the list provided by Mr. Grimsley's letter dated August 1, 1986.

In your telephone conversation on September 10, 1986, with Ms. Carol Ann Reed, she explained that the list provided was generated from a computer program that has been in existence for approximately one and one-half years. Therefore, only those material licenses that have had a licensing action during that period appeared on the list. She further explained that a complete list of licensees authorized to incinerate radioactive material does not exist and a considerable amount of time and effort would be required to create such a list.

In that conversation you requested a list of licensees in the States of Michigan, Illinois, Ohio, and Indiana.

In a subsequent telephone conversation on September 15, 1986, you were informed that a list of Region III licensees authorized to perform incineration was created in 1984, and that the Region III staff believed that the list was reasonably accurate at this time.

It was agreed in that conversation that Mr. Bruce Mallett, Chief, Materials Licensing Section, Region III, would update the Michigan portion of the list. You agreed this updated list would satisfy your initial request and this appeal.
