FEMA RESPONSE TO SUFFOLK COUNTY, STATE OF NEW YORK AND TOWN OF SOUTHAMPTON'S FIRST SET OF INTERROGATORIES AND REQUEST FOR PRODUCTION OF DOCUMENTS TO FEMA AND THE NRC STAFF 4
FEMA hereby responds to the "Suffolk County, State of New York and Town of Southampton's First set of Interrogatories and Request for Production of Documents to FEMA and the NRC staff." For convenience the paragraphs and numbered paragraphs of the request are restated and responded to individually.
NRC filed separately and these responses are solely on behalf of FEMA.
I.
Pursuant to 10 CFR ${ 2.740(b), 2.741 and 2.744, Suffolk County, the State of New York and the Town of Southampton (the " Governments") hereby request FEMA and the NRC Staff to answer separately and fully, under oath, each of the interrogatories set forth below, and to produce for inspection and copying, at the offices of Kirkpatrick & Lockhart, the documents specified below that are wtthin the possession, custody or control of FEMA, or the NRC Staff, or both.
FEMA RESPONSE: All Documents are available for inspection and copying at FEMA Headquarters, 500 C St., S.H., as of 12:01 P.M. February 20, 1987, assuming that FEMA does not object to their production, or that the documents are not available to the general public. Copies have also been made available at the offices of Kirkpatrick and Lockhart within the 30 day period authorized under NRC rules.
FEMA hereby asserts that all requirements applicable to discovery against NRC staff apply equally to FEMA pursuant to Licensing Board orders in a related proceeding. (Copies of applicable orders are hereby served on all parties with this response).
FEMA by asserting such requirements does not walve any rights it may otherwise have under the FEMA-NRC Memorandum of Understanding dated April 1985.

II.' DEFINITIONS AND INSTRUCTIONS FOR ANSWERING INTERROGATORIES AND DOCUMENT REOUESTS In responding to the interrogatories and document requests below, FEMA and the NRC Staff shall follow the definitions and instructions set forth in Suffolk County's First Request for Production cf Documents to the NRC Staff and FEMA (Oct. 10, 1986), and Suffolk County' First Set of Interrogatories to the NRC Staff and FEMA (Oct. 15, 1986), both of which were served on FEMA and the NRC Staff in connection with the Shoreham Exercise litigation (Docket No.
50-322-OL-5).
In addition, the term " reception centers" refers to LILCO's Bellmore, Roslyr and Hicksville Operations Centers which are currently designated as reception centers under the LILCO Plan.
The term "LILCO Plan",
unless otherwise stated, refers to Revisions 6, 7 and 8 of the LILCO Plan.
FEMA RESPONSE:
FEMA does not interpret any portion of the so-called " Medical Drill" conducted February 9, 1986, which is currently being litigated in the Shoreham OL-5 proceeding to be subject to these interrogatories.
III.
INTERROGATORIES AND DOCUMENT REQUESTS 1.
Identify each person whom FEMA or the NRC Staff expects to call as an expert or non-expert witness during the reception center hearings and state the subject matter and the facts on which each such witness is expected to testify.
For each expert witness identified, state the substance of the facts and opinions to which such witness is expected to testify, and a summary of the grounds for each such opinion.
FEMA RESPONSE:
The following persons will testify on reopened Contention 24:
Philip McIntire; Ihor Husar, Joseph H. Keller, Thomas Baldwin. All witnesses will testify to the extent of their knowledge or expert opinion on reopened Contention 24.

Provide an up-to-date resume for each witness identified in response to Interrogatory No. 1.
FEMA RESPONSE:
Resumes have previously been made available for the above named witnesses, with the exception of Ihor Husar which is submitted with these responses.

Identify all studies, papers, articles, reports, bocks, and other such documents, published or unpublished, upon which each witness identified in
. response to Interrogatory No. I intends to rely on in support of his or her testimony.
Provide a copy of all items identified in response to this interrogatory, except that those items readily available in the public domain need not be provided.
FEMA RESPONSE: All documents relied upon are being furnished in response to the document production request or are otherwise available to the public and will be so-described.

Identify by date, location and proceeding all prior testimony before any judicial, administrative, or legislative body, including deposition testimony, given by each of the witnesses identified in response to Interrogatory No. I concerning any aspect of emergency preparedness.
FEMA RESPONSE: All designated witnesses have previously testified in the Indian Point Proceeding or the Shoreham proceeding.

Identify all articles, papers, and other documents authored or co--authored by each FEMA or NRC Staff witness identified in response to Interrogatory No. I on the subject of reception centers, care of evacuees during emergencies, monitoring or decontamination of people or property, handling contaminated materials, traffic engineering or management, or the number of persons expected to arrive at LILCO's reception centers for monitoring.
Provide a copy of each document identified in response to this interrogatory.

Identify all documents concerning the use of LILCO's Hicksville, Bellmore, and Roslyn Operations Centers as reception centers.

FEMA RESPONSE:
FEMA's documents concerning these reception centers are made available unless otherwise objected to for inspection or copying and consist solely of documents concerning review of Revisions 6, 7, and 8, as described in the RAC review previously served on all parties to the OL-3 proceeding.

Identify all communications between LILCO and the NRC or FEMA concerning the use of the Bellmore, Hicksville, and Roslyn Operations Centers as reception centers.
Provide all documents concerning such communications.

8.
Identify all documents concerning LILCO's procedures for monitoring or decontaminating evacuees as set forth in the LILCO Plan.
Provide a copy of each document identified in response to this interrogatory.
FEMA RESPONSE:
FEMA has no documents other than the LILCO plan or documents served on the Intervenors by LILCO pursuant to its Interrogatories to LILCO.

FEMA RESPONSE:
See Index to RAC documents attached. Unless objected to, such documents are available for inspection and copying at FEMA headquarters, 500 C st., S.W., Washington, D.C. or will be furnished within 30 days pursuant to NRC rules.

Identify each RAC member and all other individuals, including all FEMA contractors, who reviewed the LILCO Plan's compliance with NUREG 0654 II.J.12 or with FEMA or NRC guidance memoranda, or other such documents, concerning reception centers or the care, monitoring or decontamination of evacuees.
FEMA RESPONSE: A complete list of all RAC members was furnished during the deposition of Ihor Husar in the OL-5 proceeding on January 27, 1987.
No other individuals had responsibility or did review the Plan for compliance with NUREG-0654, with the exception that representatives of two FEMA contractors, Joseph Keller and Dr. Tom Baldwin also reviewed the plan for compliance with NUREG 0654.
Roger Kowleski also reviewed Revision 6 as was discussed in his deposition in the OL-5 proceeding on January 28, 29, and 30, 1987. Margaret Lawless and Robert Turner also reviewed the RAC report.
IV.
PRIVILEGED DOCUMENTS Documents for which privilege is asserted are separately indexed and that index is attached to these responses. All indexed privileged documents are covered by the deliberative process privilege discussed in ALAB-773.

A native of Central New Jersey, Mr. Husar entered the emergency preparedness field in April 1979, after working seven years in security and intelligence for DoD, when hired by the Defense Civil Preparedness Agency, New York field office. Serving as a field representative, he was responsible for providing emergency preparedness financial and technical assistance to New Jersey, New York, Puerto Rico and the Virgin Islands.
Mr. Husar has been employed by FINA since its establishment and has served the New York Regional Office in many capacities.
He was Chairman, Regional Assistance Committee (RAC) for state / local response planning surrounding nuclear power plants.
He was Acting Division Chief, Plans and Preparednessa, and has responded to Presidentially declared disasters throughout Region II.
Mr. Husar performed a support role in the Love Canal emergency, as well as Puerto Rico and New York State hurricane disasters.
Until the position was abolished in June 1988, Mr. Husar was Branch Chief, National Preparedness Programs.
He was directly responsible for the management of Government Preparedness i
(Special Access Programs) and National Preparedness Programs in the region.
He was Executive Secretary, Regional Preparedness Committee (RPC) and was responsible for the Regional Emergency Response Team (RERT). Plan development.
He also served as Regional Individual Mobilisation Augmentee (IMA) Program Coordinator.
currently, Mr. Husar is Supervisory Natural & Technological Hazards Programs Specialist, in the Natural & Technological Hasards Programs Division (NTB).
As a result of an Agency Reduction in Force (RIF) Mr. Husar was reassigned to this position and was selected by the Acting Regional Director to serve again as RAC Chairman.
Mr. Husar is currently responsible for the day to day oversight of National Flood Insurance Program (NFIP) in the region as well as technological hasards programs.
The latter program area includee off-site safety surrounding commercial nuclear power plants and response planning for peace time radiological accidents (including nuclear weapons accidents) and hasardous materials.
In addition, he has retained responsibility for the Regional Emergency Response Team (RERT)
Plan.
Mr. Husar graduated from Rider College, Lawrenceville, NJ in 1967 with a Bachelor of Arts degree in Secondary Education (History).
He has completed pre-candidate work for a Masters in Business Administration degree with Southern Illinois University.

He has been the recipient of several awards during his career in the Federsi government.
Mr. Husar is a Vietnam veteran, having served four years on active duty as an Army Intelligence Officer.
He is currently a Lieutenant Colonel in the US Army Reserves.
He presently resides in Marlboro, New Jersey and married 18 years, and is the father of six children.
