SUBJECT:

RELOCATION OF A BLOOD IRRADIATOR This responds to your August 9,1999, note regarding your telephone call with Florida Congressman Bill Young's Office concerning relocation of a blood irradiator by an Agreement State of Florida licensee.

I have referred your inquiry to the Office of Nuclear Material Sa?ety and Safeguards (NMSS).

NMSS staffinformed Mr. Tim Malone of Florida Blood Services that a one-time exemption to the regulations may be possible given his situation. However, since Mr. Malone is an Agreement State licensee, he must work with the Agreement State of Florida and the U.S. Department of Transportation (DOT) to get the exemption for the relocation activity. Mr. Malone is aware of the State contact and has been given the DOT contact. NMSS staff has also provided the same information to Mr. George Cretekos from Florida Congressman Bill Young's Office.

Representatives from the Office of State Programs have discussed this issue with representatives of the State of Florida.
