SECY-86-280 - Proposed Order Establishing Informal Hearings With Respect to Denials of Materials License Applications of Perf-Master, Inc. and Radiology Ultrasound Nuclear Consultants, P.A.
The Commission, by a 5-0 vote,* approved orders responding to requests for hearings from materials license applicants Perf-Master, Inc. and Radiology Ultrasound Nuclear Consultants, P.A.,
following the NRC staff's denial of their licensing requests.
The orders. grant informal hearings to both licensees.
Each hearing will be presided over by a-single member of the Atomic Safety and Licensing Board Panel appointed by the Chairman, and the proceeding shall be guided by instructions in the orders.
(Subsequently, on October 9, 1986 the~ Secretary signed the Orders.)

- Section 201 of the Energy Reorganization Act, 42 U.S.C.
S 5841, provides that action of the Commissicn shall be determined by a " majority vote of the members present."
Commissioner Carr was not present when this item was affirmed.
Accordingly, the j
formal vote of the Commission was 4-0 in favor of the decision.
Commissioner Carr, however, had previously indicated that he j
would approve this paper and had he been present he would have l
affirmed his prior vote.
