Dear Mr. Bailey:

This is in response to your request dated September 9, 1986, for a determination pursuant to 10 CFR 150.15a(a) that the NRC concur on the termination of the licenses for four uranium processing facilities en previously licensed by the State of Texas. We have reviewed the information regarding the four licenses provided as attachments to your

, September 9, 1986 letter. Our evaluations and conclusions with respect to termination of the licenses are discussed below.

Our review indicates that the Anaconda Minerals' Rhode Ranch uranium mill

] project and Urex Inc.'s Santonino in situ mining project were never constructed. Since these sites were not constructed, it is evident no byproduct material was ever produced. Therefore, no decontamination of the sites or byproduct disposal was necessary. The remaining two sites, Mobil Alternative Energy Inc.'s Nell in situ mining project and Piedre te Lumbre-Brelun in situ mining project were decommissioned and decontaminated in accordance with applicable State requirements and we

, have found that your actions are compatible to requirements that would l have been applied at a similar facility if under Federal licensure.

The NRC, therefore, concurs with the State of Texas reviews and j subsequent termination of those specific source materials licensees identified above.
