Good afternoon, ladies and 3
gentlemen.
This is an affirmation session on a single matter, 4
as I understand it.
And ask the Secretary to please lead us 5
through that issue.
6 MR. CHILK:
The paper is SECY 86-276, is the review 7
of ALAB 840 in the matter of the Philadelphia Electric 8
Company.
Here the Commission is being asked to act on an 9
order detailing the Commission's review of the ALAB 840 and a 10-motion by Robert Anthony, Friends of the Earth, to disqualify 11 counsel for the licensee and to reopen the record of Limerick 12 proceeding on the off-site emergency plan.
13 The Chairman, Commissioners Roberts, Bernthal and 14 Carr have approved the order which is the attached to our 15 october 14th memorandum, which rules that the appeal board did 16 not have jurisdiction and therefore'is vacating ALAB 840.
The 17 order also denies the motion to disqualify counsel and reopen 18 the record.
19 Commissioner Asselstine disapproves the portion of 20 the order dealing with the jurisdictional question and 21 approves the portion dealing with the motion to disqualify and i
22 reopen the record.
His separate views are attached.
