ORDER (Resulting From June 9, 1986 Telephone Conference Call)

An unscheduled telephone conference call was held during the afternoon of June 9, 1986, in which representatives of all of the parties and I participated. Discussion was conducted on changing the June 9, 1986 filing date, for prefiled testimony and the trial plan, to June 11, 1986, and the need for Three Mile Island Alert, Inc. (TMIA) to support its request of June 5,1986, for a subpoena for Gary Milhollin, the Special Master who conducted a supplementary proceeding in the reopened phase of the TMI-1 restart case, and to allow a response by the other parties.

For good cause shown, it is hereby Ordered:

(1) The filing date of June 9, 1986, set forth in the Report And Order On Final Prehearing Conference of May 27, 1986, is changed g"iBER BOit?

to June 11, 1986 for the prefiled testimony and the trial plan. The parties are to use express mail for service. TMIA, who had already filed on June 9, is authorized to amend its filing or to make a new filing by the June 11, 1986 filing date.

(2) THIA is required to support its June 5,1986, Application For Issuance Of Subpoena, for Special Master Gary Milhollin, in a filing to be submitted on June 13, 1986. Matters to be addressed are:

(a) the adequacy of the notice in seeking the subpoena, in the context of this proceeding; (b) the general relevancy of the testimony sought; and (c) whether the request meets the requirements of 10 CFR 2.720(a)(2)(1),

which applies to subpoenalng NRC personnel. A response is permitted.

Responses are to be served on the Judge by June 23, 1986.
