Dear Mr. Dyer:

This is in response to your letter dated October 7, 1986, in which you requested, pursuant to the Freedom of Information Act (F0IA), copies of last fiscal year's F0IA report, or any records since, on the number of requests received, granted, denied, and pending; the types of requesters; the amount of time spent in processing last fiscal year's requests; and money received for copying fees.

The NRC does not prepare a fiscal year FOIA report containing the requested information. Rather, the NRC prepares an annual report for Congress on F0IA activities on a calendar-year basis, as required by the F0IA, 5 U.S.C. 552(d).

Copies of the latest report covering 1985 and reports for years 1974 through 1984, which contain statistics on denials, exemptions, and fees, were placed in NRC's Public Document Room (PDR), 1717 H Street, NW, Washington, D.C., in response to a previous F0IA request. These reports are filed in PDR folder F01A-86-564 under the name Fitzgibbon.

In addition, this office prepares a report each week which lists the requests received during that week and identifies the requesters and subject matters of the requests. This report becomes Enclosure A of NRC's Weekly Information Report, which is also made available for public. inspection at the PDR.

For your information, we are enclosing copies of the NRC's report to Congress on the F0IA for 1985, and Enclosure A of the Weekly Information Report for the week ending October 3, 1986.

In the event you wish to receive additional reports, we are also enclosing a notice that provides information on charges (five cents per page) and procedures for obtaining copies of records from the PDR. As provided in NRC's regulations at 10 CFR 9.14a, NRC would not waive reproduction costs for additional records publicly available at the PDR in the absence of a compelling reason to do so.
