Dear Mr. Chairman:

In reference to your letter of September 15, 1986 related to the safety of boiling water reactors (BWRs) and MARK-I containments, the agency will keep you informed as information develops and decisions are made concerning what changes might be made to enhance the safety of these plants. There are a number of ongoing and related studies by the NRC and industry on the -

capability of BWRs, particularly with MARK-I containments, to mitigate the consequences of a severe accident.. Copies of two reports on industry studies were recently forwarded to you for your information and use.

The NRC is in the process of reviewing the results of these studies and will be reviewing other information when available to assess potential modifications either in hardware or procedures to enhance plant safety for BWRs with MARK-I containments. As noted in your letter, the staff is considering issuing a draft generic letter as early as December 1986.

However, this decision is still subject to review hy the Committee for Review of Generic Requirements. A decision on the most appropriate mechanism to implement any proposed modifications (ge. ., generic letter, rulemaking, or Orders for Modification of License) will impact-the timing of any proposed modifications. The Commission will comply fully with all notice, comment and public participation requirements.

The agency is fully aware of the level of public interest in this subject and as appropriate will attempt to keep the public informed on initiatives and decisions in this area. As you noted in your letter, it is vital for both the public and regulated industry that the Commission have the best possible information on which to base its decisions and, as such, we will use all of the information developed by the NRC, the industry and any other organization in making our assessment. The Commission intends to keep closely abreast of staff activities in this area and we will give timely consideration to the recommendations of the NRC staff on this subject.
