Dear Ms. Reeves:
I am responding to your letter of July 22,1997, to the Executive Director for Operations of the U.S. Nuclear Regulatory Commission (NRC), in which you appeal the NRC's initial Freedom of Information Act (FOIA) decision on FOIA 97-27.
First, you indicate that the NRC failed to address six records you identified with arrows in your initial FOIA request. We addressed four of the six records listed in your July 22,1997, letter in our responses to your request:
- 1. Accession Number 8601240416 was addressed in the June 23,1997, response at Appendix H number 19, and releared in part;
- 2. Accession Number 8601040143 was addressed in the June 11,1997, response at Appendix F number 3, and withheld in its entirety;
- 3. Accession Number 8002210263 was addressed in our June 9,1997, response at Appendix B number 1, and is already publicly available in the NRC Public Document Room (PDR);
and
- 4. Accession Number 8002210272 was addressed in our June 9,1997, response at Appendix -
C number 14, and released in its entirety.
The records that were released either in whole or in part were sent to you in our response, and we directed you to the PDR to obtain the subject record maintained on file there. The record identified by Accession Number 8003030126 is a duplicate of the record identified by Accession Number 8002210263, which is discussed above. The last record on your list, Accession Number 9507030161, was not marked with an arrow in your initial request; therefore, it was not addressed.

. You also appealed the dental of four records withheld in their entirety pursuant to FOIA Exemption 1, which are identified on the enclosed appendix. We reviewed these again and the records will continue to be withheld because they are Confidential Restricted Data properly classified pursuant to Executive Order 12958. The information in these records is exempt from Public disclosure pursuant to Exemption (1) of the FolA (5 U.S.C. 552(b)(1)) and Section 9.17(a)(1) of Title 10 of the Code of Federal Regulations. Therefore, your appeal is denied.
