NRC INTEGRATED INSPECTION REPORT 50-334/97-06, 50-412/97 06,

EXERCISE OF ENFORCEMENT DISCRETION

Dear Mr. Cross:

The NRC conducted an inspection of the Beaver Valley Power Station (BVPS) facilities from

July 20 to August 30,1997. The enclosed report presents the results of that inspection.

l

During the 6 week period covered by this inspection period, your conduct of activities at

the BVPS facilities was generally characterized by safe operation. Your staff responded

l

appropriately to the August 7,1997, Unit 1 reactor trip. The root cause investigation of

f

the reactor trip was rigorous and demonstrated good coordination between departments.

Good teamwork and control were also noted in response to a Unit 2 main turbine governor

l

valve stem anti-rotation device problem.

The NRC also reviewed the circumstances surrounding your identification and corrective

action taken regarding the identification of additional non seismically qualified fire

suppression system actuation switches and relays on the Unit 1 emergency diesel

generators and the supplemental leak collection and release system for both units. The

issues were identified by your staff during your " extent of condition review" for a

previously identified similar condition on the fire suppression system for the Unit 1

emergency diesel generators. The NRC considers your initiatives to identify long-standing

design issues a strength. Corrective actions taken and planned to prevent recurrence of

similar design deficiencies were comprehensive.

The above problems are apparent violations of NRC requirements which would normally be

considered for escalated enforcement and subject to a civil penalty. However, after

consultation with the Director, Office of Enforcement, I have been authorized to not issue a

Notice of Violation and not propose a civil penalty in this case in accordance with the

provisions of Section Vll.B.4 of the NRC's Enforcement Policy. This decision was made

after consideration that: (1) the violations were identified by your staff as part of the

corrective action for the previous issue with the non-seismically qualified relays in the fire

suppression system for the Unit 1 emergency diesel generator; (2) they had the same root

cause as the previous issue; (3) they did not substantially change the safety significance or

the character of the regulatory concern arising out of that finding; and (4) corrective

actions, both taken and planned, were comprehensive and reasonable. The exercise of -

discretion acknowledges your good effort to identify and correct subtle violations, that

would not be identified by routine efforts, before the degraded safety systems are called

upon.
