Millstone Nuclear Power Station, Unit Nos.1,2, and 3 Updated Reolv to Notice of Violation and Proposed imoosition of Civil Penalty (EA 97-104)

The purpose of this letter is to update the Reply to Notice of Violation (NOV) and

Proposed Imposition of Civil Penalty which was submitted by Northeast Nuclear Energy Company (NNECO) on behalf of Millstone Unit Nos.1,2 and 3, dated July 11,1997 '

In a letter dated July 11, 1997, NNECO provided a reply to an NOV and proposed imposition of civil penalty associated with an NRC security inspection conducted between February 3-7,1997. The civil penalty pertains to a severity level ill problem for multiple instances of inadequate controls of safeguards information and inadequate implementationof the security plan for vehicle control. During an NRC securityinspection conducted July 28 to August 1,1997, the NRC Staff determined that further information is required tc assess the adequacy of the violation response for the control of vehicles and safeguardsinformation. Specifically,the NRC has asked for clarification of the statement:

"The corrective actions taken have not resulted in the improved performance desired in the control of safeguards material and the control of vehicles in the protected area. As a consequence. senior station management will prescribe additional measures of ccrrective action that will be implemented expeditiously."

U.S. Nuclear Reguletory Commission B16690\\ Page 2 The statement that the corrective actions taken have not resuited in the improvod performance desired pertains to the fact that the management of Millstone Station is raising the standards for performance in these areas. An additional corrective action taken since the July 11,1997 response is that we have significantly reduced the number of vehicles in the protected area. Even recognizing that the corrective actions taken have resulted in improved performance, an important element of continuously improving performance is that management support of security requirements be visible and apparent to the workforce. For that reason, senior station management has added the additional corrective action of interviewing persons responsible for infractions and their supervisory chain to gain insights into the effectiveness of corrective actions taken and to reinforce management support of the security program, it is expected that this additional corrective action will be relaxed after a sustained period of improving and acceptable performance. This additional corrective action was incorporated into the corrective action j

plan for Condition Report CR M1-97-1016 and became effective July 31,1997.

The corrective actions taken have resulted in improvements for the control of safeguards niaterial and the control of vehicles. The effectiveness of these corrective actions, both near term and long term, are being monitored and assessed. Adjustments to the i

corrective actions may be warranted based on these assessments.

Commitments There are no new commitments made within this letter.

NNECO reiterates the commitments to monitor the effectiveness of corrective actions as described in the letter of July 11,1997.

B16536-01 A station-wide trending program which will provide a tool to assess the effectiveness of near term corrective actions for human performance will be in place by September 30,1997.

B16536-02 The long term effectiveness of corrective actions will be determined by a station wide self-assessment which will be completed by March 1,1998.
