Washington, DC 20555 APPEAL FROM AN INITIAL FOIA DECISION
Dear Sir,
This is an appeal under the Freedom of Information Act, as amended, to the NRC response to FOIA-85-358 (Bell) on the grounds that it is believed to be incomplete.
The request specifically asked for documents related to allegations made by Frank Peguese regarding construction defects at Shearon Harris. Mr. Peguese's allegations were made in March of 1985. All but one of the documents included in the response pre-dated the allegations--most pre-dating them by several years.
The documents cited as being located in the PDR did not address I
or relate to Mr. Peguese's concerns. Further, the initial FOIA request asked for documents concerning cracks and/or leaking in the containment and other buildings at Shearon Harris. The response did not include documents addressing this issue.
After Mr. Peguese made his allegations, the NRC licensing board called for an investigation into these allegations. We believe that documents must have been generated relating to these concerns, which would fall into the categories of documents requested in the initial FOIA and which should have been included in the response, given that the allegations were made in March 1985, the FOIA request made in May 1985, and the response finalized in February 1986--nearly a year after the original allegations.
