Supplementary information: As part of our process of providing. Agreement States opportunity for early and substantive involvement in NRC's rulemaking activities, we have been providing you with copies of draft rulemaking plan documents for review and comment before they are approved by the Commission. In our letters providing copies of these plans, we have indicated that the plans are pre-decisional documents which are generally exempt from public disclosura requirements. Therefore, in each of our letters, we have requested that you limit distribution of such documents to your staff and that you not reMase the documents publicly to the extent permitted by State law.
We request confirmation from you that under your State's public disclosure laws, you have the legal authority to withhold pre decisional NRC information from public disclosure. We also request information about your ability to withhold from public disclosure other information or documents which we may provide to you that are labelled pre-decisional, such as early drafts of licensing guidance documents, dratt inspection procedures, or proposed escalated ersforcement actions.
Finally, some States have indicated that additional labelling of pre-decisional NRC-g documents with supplemental labels, such as " enforcement sensitive information" or
" internal agency use only" would assist States in withholding documents in accordance g
with individual State public disclosure laws. We would appreciate knowing if your State laws contain restrictions or preferences on labelling, or whether specific labelling would assist in meeting the intent of the NF:C pre decisional labelling under State law.
