Midwest Office IN RESPONSE REFER

3424 Marcus Lane TO F01A-86-192 AND

Appleton, WI 54911 86-A-54

Dear Ms. Garde:

This is in response to your letter dated March 18, 1986, in which you requested,

pursuant to the Freedom of Information Act (F0IA), all documents regarding

Inspection Report Nos. 50-445/85-07 and 50-446/85-05 conducted during the period

April 1,1985, through June 21, 1985, for the Comanche Peak plant.

A copy of the document identified on the enclosed Appendix A is being placed in

~

the NRC Public Document Room (PDR), located at 1717 H Street, NW, Washington,

DC.

The documents listed on the enclosed Appendix B are drafts and coments on

drafts and are being withheld from public disclosure pursuant to Exemption 5 of

the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Comission's regula-

tions. Disclosure would inhibit the candid and frank exchange of comunications

in future deliberations and would not be in the public interest. There are no

reasonably segregable factual portions, and the documents are being withheld in

'

their entirety. The document identified on enclosed Appendix C contains infor-

mation which is confidential business (proprietary) information. This information

is being withheld from public disclosure pursuant to Exemption 4 of the F0IA

(5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Comission's regulations.

Pursuant to 10 CFR 9.9 of the Comission's regulations, it has been determined

that the information withheld is exempt from production or disclosure, and that

its production or disclosure is contrary to the public interest. The persons

responsible for this denial are the undersigned and Mr. Robert D. Martin,

Regional Administrator, Region IV.

This completes action on your request. In light of this letter, we are taking no

further action on your April 8,1986, letter appealing our lack of response to

your F0IA request.

Sincerely,

fN Iwa /W( .
