In a March 27, 1986 letter from Mr. W. D. Shafer of Region III, your Company was informed that the two checks for GSEP Annex Revision No. 1 for Braidwood and Revision 4 for Dresden had not been received and recommended that your Company stop payment on these two checks.
In addition, the letter returned your Check No. 0028462 for $150 for the LaSalle Annex revision. A search of our records has not located a $150 check since January 1986 for any Dresden GSEP revision. However, we found that by your letter dated March 7,1986 to Mr. J. G. Keppler, you remitted Check No. 0027585 dated March 5,1986, for a February 27, 1986 Revision 1 to the Braidwood GSEP Annex. This check was deposited for payment on March 19, 1986, and according to the NRC's Office of Resource Management, there is no record of payment having been stopped for it.
Since the Braidwood units are undergoing operating license (OL) review, the review cost for the Braidwood revision is part of the OL review fee.
Therefore, the $150 application fee that your Company paid by letter dated March 7 is not applicable, and we would like to recommend that credit for this $150 application fee be given to a subsequent application filed by you for any of the licensed Comonwealth reactor facilities.
To receive such credit, you need only reference the Check No. (0027585) anddate(March 5,1986).
The purpose of the balance of this letter is to address the applica-bility of fees under the provisions of the currently effective Part 170 for the following types of submittals:
1.
Emergency Plans / Procedures, 2.
Operator Requalification Program, 3.
Quality Assurance Plans not submitted as a topical report or revision to an accepted report, and 4.
Security / Safeguards Contingency Plans.

Item 1 above:
The review of initial plans and changes to these plans are part of the OL review costs until licensees receive a 100% power OL. Therefore, the
$150 application fee is not applicable for plants under OL review or in instances where 100% power operation has not yet been authorized. Once the OL is issued for 100% power operation, any change requiring NRC approval because it decreases the effectiveness of the approved plans (10 CFR 50.54(q)) is subject to the $150 application fee and review costs in accordance with 10 CFR 170.12(c) and 170.21.A.
Items 2 through 4 above:
Until companies receive their first license (fuel loading or low power operation), the review of initial plans / programs and changes thereto is part of the OL review costs. The $150 application fee is not applicable for plants under OL review. After the issuance of the first license, l
the $150 application fee is required for each change, revision, amend-ment or supplement that decreases the effectiveness or commitment of the 4
approved plan which requires NRC review and approval under the pro-visions cf 10 CFR 50.54(a)(3); 50.54(1-1) or 50.54(p)/50.90. Licensees are billed for review costs in accordance with 10 CFR 170.12(c) and 170.21.A.
Topical reports and each revision, amendment or supplement to an accepted topical report are subject to the $150 application fee and the review costs provisions of 10 CFR 170.12(f) and 170.21.J irrespective of the nature of the change.
We hope that this letter clarifies the requirements of 10 CFR 170 on the above items.
