Dear Mr. Murphy:

Pursuant to Subtitle E of the Small Business Regulatory Enforcement Fairness Act of 1966, 5 U.S.C. 801, the Nuclear Regulatory Commission (NRC) is submitting two final policy statements.

Section 274 of the Atomic Energy Act (AEA) of 1954, as amended, provides for a special Federal-State regulatory framework for the control of radioactive rnaterials under which the NRC may, by agreement with a State, relinquish its authority in certain areas to the State government as long as the State program is adequate to protect public health and safety l

and compatible with the Commission's program. Section 274 further directs the Commission to review periodically State programs to ensure compliance with provisions of Section 274. The NRC has developed two final policy statements pertaining to the administration of programs carried out under Section 274.

Statement of Princioles and Poliev for the Aareement State Proaram. This policy statement establishes Agreement State Program principles and describes the respective roles and responsibilities of the NRC and the States in the administration of this program. This policy statement will provide guidance in delineating the NRC's and the State's respective responsibilities and expectations.

Poliev Statement on Adeausev and Comoatibility of Aareement State Proorams. This policy statement clarifies the meaning and use of the terms " adequate" and " compatible" as applied to'an Agreement State radiation control program. This policy statement provides guidance to the Agreement States, NRC staff, and the public to make clear how the Commission intends to evaluate the adequacy and compatibility of Agreement State programs.

-We have determined that these policy statements are not " major rules," as defined in 5 U.S.C. 804(2). We have confirmed this determination with the Office of Management, and Budget, nA,7~
