2. 1.2 Site Description and' Exclusion Area Contrei The site consists of approximately 2450 acres which extend southward from the bank of the Chehalis River and up the southern ridge of the

. valley. The planned location of the plant structures is about 370 feet above the valley floor. The principal features of the site in-cluding the major plant structures, exclusion area and site boundary lines are shown in Figure 2.2.

The exclusion area is approximately circular in shape with a minimum boundary distance of 4,300 feet (1,310 meters) measured from approxi-mately the center of either reacter building. The applicant owns only part of the exclusion area. As shown in Figure 2.2, all of the plant structures will be within the part of the exclusion area owned by the applicant. The balance of the exclusion area not owned by the applicant consists of commercial tree farms.

The applicants will obtain the authority to determine all activities within the exclusion area by entering into agreements with the other land owners which convey through the granting of appropriate easements to the applicant the authority to control access to the non-owned properties. The only activities which will be permitted on the non-owned properties within the exclusion area will be those associated with timber farming and these activities will be controlled through the use of easements. Agreements have been reached which cover the majority of the non-owned properties within the exclusion area.

s 5 Negotiations are continuing with the other property owners including the State of Washington with whom agree =ents have not been signed to date. The applicant states that in the event agreement cannot be reached for control of these properties, the properties will be obtained through outright purchase or through eminent domain proceedings.

The applicants have purchased mineral rights on all lands acquired in fee.

The mineral rights for the non-owned lands within the exclusion area vill not be acquired by the applicants, however, the easements en these properties include control over mineral rights and specifically exclude mineral enploration and mining operations.

The exclusion area is not traversed by any public waterways or rail-roads. A Grays Harbor County Road, an extension of Keyes Road, will provide vehicular access to the exclusion area. A Bonneville Power Administration transmission corridor runs through the lower part of the exclusion area. The applicant has initiated discussions with the County and BPA to obtain agreements granting the applicant the authority to control access to the exclusion area on these routes.

We conclude that the agreements and easements entered into by the applicant, and the commitment to purchase outright or use eminent domain proceedings if necessary to obtain control over the properties not yet acquired within the exclusion area, provide reasonable assurance that the applicant will have the authority to control all activities within the exclusion area, as required by 10 CFR Part 100. However, before reaching a final conclusion on this matter, we will require
