NRC REVIEW AND NOTICE OF VIOLATION

Dear Mr. Godfrey:

This refers to an NRC tolephonic review on August 8,1997 (with continuing NRC in-office review through August 20,1997), regarding your use of a moisture density gauge in July 1997 at the Iowa Army Ammunition Plant, Middleton, Iowa.

During the review, the NRC identified that a Form 241 " Report of Proposed Activities in Non-Agreement States' was not sent to NRC Region til office in accordance with NRC regulations before using a moisture density gauge containing byproduct material for five days in July 1997 at the Iowa Army Ammunition Plant, a federal facility. An NRC Form 241 is required to be submitted to the appropriate NRC regional office for all cases where licensed activities involving byproduct material are to be used by agreement state licensee's in NRC jurisdictional areas (i.e.: federal facilities).

This violation is cited in the enclosed Notice of Violation (Notice). Please note that you are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's ' Rules of Practice," a copy of this letter, the enclosure, and your response to this letter will be placed in the NRC Public Document Room (PDR). To the extent possible, your response should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.
