NOTICE OF VIOLATION.

Battelle Columbus Laboratory License No. R-4 As a result of the.inspe~ction conducted on January 12-16, 1987, and in

'accordance with the " General Policy and Procedures for NRC Enforcement Actions " 10 CFR Part 2, Appendix C (1985), the following violation was.

identified:

.10 CFR 50.10(a) states that no person shall, among others, )rocess~or use a utilization facility.unless authorized by a license issued )y the commission.

Contrary to the above, License No. R-4 which authorized possession of the Battelle Research Reactor and of byproduct material produced by operation of the facility, expired on ' August 5,1980, and no renewal application was submitted until December 10,-1986.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or-ex1)lanation in reply, including for each violation:

(1)correctiveaction taken and the results achieved;'(2) corrective. action to be taken-to avoid

.further violations; and (3)-the date when full compliance will be achieved.-

Consideration may be given to extending your response time for good cause shown.
