Please come to order.
This.is an affirmation 4
session.
We have one item on the agenda and I will ask the 5
Secretary to lead us through that item.
6 SECRETARY CHILK:
The paper before the Commission, 7
Mr. Chairman, is SECY-86-118, a Request for Hearing by 8
Mr. Arnold and Mr. Wallace.
9 In this paper the Commission is being asked to 10 approve an order which responds to a request from Mr. Arnold 11 and Mr. Wallace for a hearing on the adverse implications of 12 their integrity drawn in the TMI-l Restart Proceeding.
13 The proposed order which is before you finds that 14 with regard to Mr. Arnold, there is no reasonable basis to 15 conclude that he made a knowing, willful or reckless material 16 statement in a notice of violation response and therefore, no 17 hearing is necessary.
18 The proposed order grants a request for a hearing by 19 Mr. Wallace and established that it provides guidance to the 20 licensing board.
21 Commissioners Roberts, Bernthal and Zech have 22 approved the proposed order as it was modified by 23 Commissioners Bernthal and Zech.
The Chairman and Commissioner Asselstine have approved in part and disapproved 24 25 in part.
They would have held a hearing for both Arnold and 4

Chairman Palladino will be attached to the order.
