Dear Mr. Swanson:

This is in response to your letter dated March 6, 1986, in which you requested, pursuant to the Freedom of Information Act (F0IA), proposal records submitted by the successful offeror in response to Request for Proposal RS-NRR-86-055 entitled " Assessment and Application of Thermal Hydraulic Phenomena for Severe Accident Decisions." In addition, you requested a copy of the evaluation by the NRC Scurce Evaluation Panel (SEP) of the winning proposal. .. -

In a telephone conversation between you and David Meyer of my staff on March 27, 1986, you agreed to accept a nonproprietary version of the successful proposal. The proposal you requested, as described on the enclosed Appendix A, is now available for public inspection and copying at the NRC Public Document Room (PDR) in file F0IA-86-160 under your name.

The evaluation by the NRC SEP of the successful offeror's proposal, as described on the enclosed Appendix B, is being withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5)

, of the Comission's regulations. This document is withheld in its entirety-because it contains predecisional opinions of the SEP regarding the proposals submitted for the aforementioned procurement. The release of this evaluation would tend to inhibit the open and frank exchange of ideas essential to the deliberative process. There are no reasonably segregable factual portions because release of the facts would permit an indirect inquiry into the predecisional process of the agency.

Pursuant to 10 CFR 9.9 of the NRC's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Edward L. Halman, Director, Division of Contracts, Office of Administration.

should clearly state on the envelope and in the letter that it is an " Appeal from an Initial FOIA Decision."

Enclosed is a copy of a notice which explains the procedures and charges for obtaining records from the PDR.
