Dear Mr. Grimsley:
As nominal party to the above-captioned 10 CPR 2.206 proceeding, and as counsel for Vera M. English pursuant to FOIA, the undersigned hereby requests a copy of the letter dated May 9, 1985, from General Electric Company (GE) to the Second Region, NRC, mentioned in p.
8, par. 7, of IR 85-04, and also in the letter from Stohr to Lees re IR 84-15, dated 3"
July 11, lh J.
I hereby also request a copy of any memorandum or memoranda, file note or other writing, whenever made, prepared by D. M. Collins of Region II of a telephone conversation between him and C. M. Vaughan of GE on July 10, 1985.
That conversation is also referred to in IR 84-05, id.,
and in the letter from Stohr to Lees of July 11, 1985, M.
I-also hereby request a copy of the responses of GE dated March 7 and May 9, 1985, to the Notice of Violation issued on February 7, 1985 as part of IR 84-15, likewise referred to in the'aforesaid letter from Stohr to Lees dated July 11, 1985.
None of the documents herein requested are on file in 70-1113, in headquarters PDR.
These documents are urgently needed because they are judicially noticeable in English v. GE, 85-ERA-2, pending sub judice before the Secretary of Labor and officially noticeable in the pending S 2.206 proceeding.
My entitlement to them is predicated not only upon FOIA, but upon 10 CFR S 2.744, inasmuch as I am a " party" to the 2.206 " proceeding,"
as the quoted terms are defined in Florida Light & Power Co.
- v. Lorion, 105 S.Ct. 1598 (1985).
The specified documents are relevant and material to the issues in that proceeding and in DOL case 85-ERA-2.
