Dear Ms. Mahoney:

This is in further response to your letter dated February 21, 1986, in which you requested, pursuant to the Freedom of Information Act (FOIA), copies of documents concerning inspections, letters and citations with regard to the l Washington Hospital Center, 110 Irving Street, NW, Washington, DC, and Capitol Hill Hospital, 700 Constitution Avenue, Washington, DC, for the last five years.

Portions of the records listed on the enclosed Appendix B as documents .81, 82,.

and B3 have been deleted in order to withhold the names of persons exposed to radiation. Because disclosure of this information would constitute a clearly unwarranted invasion of personal privacy, it is being withheld from public disclosure pursuant to Exemption (6) of the F0IA (5 U.S.C. 552(b)(6)) and 10 CFR 9.5(a)(6) of the Commission's regulations. The released portions of documents B1, B2, and B3 are being placed in the PDR in folder F01A-86-104 under your name.

Document C1 listed on the enclosed Appendix C contains information which S

constitutes advice, opinions and recommendations of the staff. This information is being withheld from public disclosure of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of pursuant to Exemption (5) the Commission's regulations.

Documents C2 and C3 listed on the enclosed Appendix C contain information from a confidential source and they are being withheld from public disclosure pursuant to Exemption (7)(D) of the F0IA (5U.S.C. 552(b)(7)(D)) and 10 CFR 9.5(a)(7)(iv) of the Commission's regulations.

Pursuant to 10 CFR 9.9 of the Comission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Dr. Thomas E.

Murley, Regional Administrator, Region I, King of Prussia, Pennsylvania.

Ms. Mahoney This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10' CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

Also, you may wish to examine NRC records on file in the PDR in file number F0IA-84-789 (ENGEL). This file contains documents made available for public inspection and copying in connection with a F0IA request similar to yours which we responded to on January 9, 1985.
