NRC COMPLETENESS REVIEW OF DRAFT OKLAHOMA AGREEMENT STATE APPLICATION The Radiation Management Section, of the Oklahoma Department of Environmental Quality, plans to submit a draft Agreement State application on September 17,1999.

We plan to follow a revised and streamlined process for reviewing the Oklahoma request, similar to that used for the Pennsylvania review. The first step will be a completeness review performed within about 60 days of receipt to determine whether the Oklahoma request contains all the essential parts and does not contain any obvious fatal flaws that would prevent staff from completing a detailed review against the criteria for new agreements. The completeness review would be performed by a team, and I am asking that you identify a representative from your Office who could serve on this review team. I would also appreciate your identifying the lead management contact in your Office who, if necessary, can help provide management oversight for the review. I would appreciate a response by August 27,1999.

To perform the completeness review, the team would need to meet for one week at a single location. Prior to the meeting, a copy of the draft application would be provided to each team member for review. We will secure a dedicated conference room for the team to conduct work and deliberations. The team's product would be a response to Oklahoma either indicating the application is complete and ready for formal submittal by the Govemor, or identifying areas in the application where additional information is needed. (A response letter to Oklahoma would be circulated for Office concurrence). Based on the Pennsylvania application, I believe that the team should be able to complete a review within 4-5 weeks (2 weeks for each team member to review their assigned area of responsibility, one week for a team meeting to prepare the review team's product, and 1-2 weeks for concurrence).

Oklahoma plans to adopt regulations by reference. During May 1997, we reviewed the proposed Oklahoma regulations covering Radiation Management, equivalent to 10 CFR Part

20. At that time, we determined that the proposed regulations would mest the compatibility l

criteria if the regulations were adopted incorporating our comments and without other significant changes, We are currently conducting a review of all of the proposed regulations that would be adopted by reference which were submitted by Oklahoma on July 15,1999. This review and response to Oklahoma would be handled separately from the completeness review of their application.

The Office of the General Counsel conducted a review of Oklahoma's enabling legislation in November 1995, and, at that time, concluded that the statutes provided an adequate basis for an agreement pursuant to Section 274b of the Atomic Energy Act.

Once team members are identified, Patricia Larkins, Project Manager for the Oklahoma Agreement, will coordinate arrangements for the completeness review team meeting.
