Dear Mr. Goff:
Thank you for your letter dated July 9,1997, which responded to the comments and recommendations from the Integrated Materials Performance Evaluation Program review of the Mississippi radiation control program.
With regard to item eight, discussions with Mr. Gordon provided additional clarification to your response to our recommendation that the State's use of deficiencies closely follow-Mississippi's revised enforcement procedure, particu'arly when regulations are cited.
We understand that in the examination of your enforcement procedure in order to address NRC comment number eight, that Mississippi has determined that the flexibility is needed to classify a minor safety finding tied to a regulation as a deficiency since the State does l
i not have severity levels for violations. Wa understand that Mississippi plans to revise the enforcement procedure to allow this flexibility. We agree your action for this item and the other items are appropriate. The IMPEP team will evaluate your efforts during the next review of your program.
We welcome the constructive approach that you and our staff have used throughout the y
program review and look forward to our agencies continuing interaction.
