Clarification ofinformation it has come to our attention that certain information LHC provided during the meeting on July 22, 1997 was not fully understood by NNECo. The purpose of this letter is to provide clarification of this information.

On July 22, LHC presented the results of the review of the ECP implementation. One of the findings was that "Some employees have lost confidence in the ECP,37% of the 27 employees contacted in

' follow-up, who had filed a concern, expressed dissatisfaction and would not reuse the program."

The major complaint of ECP users who would not use the program again was the reliance of the ECP on Human Resources to address issues of work related harassment, intimidation, unfairness in personnel matters and poor management. As stated by one former user of the ECP:

"I would have gone directly to HR ifI wanted to, I didn't choose to go there because I don't trust them. IfI knew that the ECP was going to refer my concerns back to HR, I would not have bothered."

This sentiment captures the majority of the commentary for employees that were dissatisfied with the ECP to the point they would not use it again. The same sentiment was also expressed by an even larger percentage of those contacted who had used ECP and were willing to consider using the ECP again if a technical / safety issue arose.

' While, LHC did not undertake to determine the basis for the distrust of the HR department, we have observed that there remains a deep seeded distrust of the Human Resources Department, corporate HR representatives doing ECP investigations, and site HR representatives. .t

Bruce D. Kenyon Page 2,ITPOP 97 0026 An additional fmding presented during the July 22 meeting was that sorne of the ECP files should not have been classified as either resolved or closed. We subsequently provided examples of why we had reached this conclusion. The predominate reason for our conclusion was that the lack of documentation in the files which should have included the llR reviews and investigations that were relied on to classify these files as resolved or closed.
