LAND ANNOTATION FOR THE VITRO PROCESSING SITE

Dear Mr. Rael:

The U.S. Nuclear Regulatory Commission staf f has reviewed the U.S. Department l

of Energy (DOE) submittal of June 4.1997, that included the )roposed deed i

annotation language the former Vitro processing site in Salt _ake City, Utah.

l The annotation (Notice of Residual Radioactive Contamination) fulfills the State of Utah's responsibility under subsection 104(d) of the Uranium Mill lailings Radiation Control Act and provides a means to ensure the long-term 3rotection of public health at the site, from the residual radioactWity.

Our only concern is that the notice might not stay with the deed long-term, or if the property were subdivided.

If the State has indicated that a mechanism is in place to keep the notice with the deed (s) long-term, that would address the concern.

My staff had done a brief review of your submittal earlier and suggested several corrections to the proposed annotation document (notice) in a phone conversation with Sharon Arp, DOE Project Manager, on-June 26, 1997. The suggestions were:

1.

Section A of the proposed notice should refer to Exhibit 1 and the exhibit (now labelled Figure 2-5) should be so labelled.

2.

Section E refers to Exhibit 2, but the referenced map is labelled Figure 1.

3.

Figure 1 indicates an area of radium contamination in the southwest corner of the property, adjacent to 3300 South Street.

This is not one grid (100 square meters) with elevated radium, but the supplemental standard crea of contamination along the water and gas lines. The figura should be revised to reflect this.

The staff is preparing the Completion Review Report for the Vitro site and should be able to provide that to yoJ by the end of August, if we have the signed corrected notice and are assured that the deed annotation process is underway.
