ORDER PROHIBITING INVOLVEMENT IN NRC-LICENSED ACTIVITIES (EFFECTIVE IMMEDIATELY) PENDING FURTHER ORDER This is to inform the Commission that an Order Prohibiting Involvement in NRC-Licensed Activities (Effective Immediately) Pending Further Order is being issued today to Magdy Elamir. M.D.
This action is based on evidence obtained during an Office of Investigations (01) investigation which indicates that Dr. Elamir, the owner of Newark Medical Associates, deliberately submitted an inaccurate application for an NRC license for that entity.
The application listed an individual as the sole authorized user and radiation safety officer (RS0) even though that individual had no knowledge of the application and had never agreed to fulfill those functions. After a license was granted which named the individual as the authorized user and RSO, Newark Medical Associates l
conducted licensed activities even though the named individual did not ever serve as authorized user or RSO, Since the prohibition against Dr. Elamir extends to owning an NRC-licensed facility, and given the facts described above, a Demand for Information is being issued concurrently to Newark Medical Associates to show cause why the license should not be suspended or revoked.
It should be noted that the individual has not been informed specifically about the enforcement action. The schedule of issuance and notification is:

Dr. Elamir has 20 days from the date of the Order in which to request a hearing on the Order.
