Dear Mr. Key:
I am responding to your July 7,1997, letter in which you requested that the NRC perform a courtesy review of information on an air-supplied suit and provide the Oil, Chemical, & Atomic Workers International Union (OCAW), AFL-CIO, Local 3-550, with our position.
NRC regulations at 10 CFR 20.1703(a)(1) require facilities to use only respiratory protection equipment that is tested and certified or had certification extended by the National Institute for Occupational Safety and Health /Mine Safety and Health Administration (NIOSH/MSHA). If the air-supplied suit has received NIOSH/MSHA certification, USEC would be permitted under NRC regulations to use the suit without any further involvement by the NRC. However, if the suit is not NIOSH/MSHA certified, specific NRC approval for utilization of the suit is necessary.
Facilities may request permission to use equipment that has not been tested or certified or had certification extended by NIOSH/MSHA. Any request for such permission must be made under 10 CFR 20.1703(a)(2) and would need to be made by the Certificatee, the U.S. Enrichment Corporation (USEC). The application for authorized use of any equipment should include a demonstration by testing nr a demonstration on the basis of reliable 'est information that the material and performance characteristics of the equipment are capable of providing the proposed degree of protection under anticipated conditions of use.
The NRC would consider any USEC request under 10 CFR 20.1703(a)(2) for peimission to use the air-supplied suit, if OCAW wishes to pursue this issue, I encourage you to discuss the matter with USEC management and work with them on an amendment that would request permission to use the suit and provide the necessary information to support such a request.
