PETITION FOR RULEMAKING (PRM 15)

FILED BY JEFFERY C. ANGEL On July 15,1999, you requested our review of the subject petition and a determination on whether it qualifies for handling as a fast-track petition for rulemaking. We have determined th.at the petition does not meet the conditions specified in Section 11.17(c) of the Regulations Handbook, and therefore does not qualify for fast-track handling. Specifically, the subject involves policy issues. For example, the current regulation,10 CFR 35.60(c) requires the use of a syringe radiation shield when administering a radiopharmaceutical by injection unless the use of the shield is contraindicated for that patient or human research subject. However, the petitioner is requesting that the Nuclear Regulatory Commission (NRC) prohibit the hand-held administration of radiopharmaceuticals and require the use of the Angel Shield, a radioactive substance administrator.

We concur in your draft Federal Register notice of receipt of the petition, and we have designated Sally L. Merchant as the task leader for action on this petition.
