Chairman Jackson Commissioner Dieus Commissioner McGaffigan Commissioner Merrifield FROM:

Commissioner Diaz

SUBJECT:

NEVADA PUBLIC MEETING ON SPENT FUEL TRANSPORTATION After returning from my recent visit to Yucca Mountain, and reading the different letters from Nevada officials requesting extension of the comment period for the supplemental GEIS and related rulemaking on the transport of spent fuel for license renewal, as well as a public meeting j

in Nevada to discuss transportation issues, I am sympathetic to the viewpoint that transportation issues need further exploration. Therefore, I propose that we establish a dual tract treatment of transportation issues that is responsive to the concerns of the people of Nevada. The present treatment of high-level waste transportation to the repository under license renewal should be maintained in its present schedule while a separate track, lagging (60-90 days), should be

)

established to consider arguments from Nevada, including a public meeting on the issue.

]

l believe such a meeting will aid us in reviewing these issues in the Department of Energy's Environmental Impact Statement for the proposed geologic repository while separately maintaining the integrity of the license renewal process.
