SUBJECT:

CO 49-002 - NEVADA PIIRLIC MEETING ON bvENT FUEL TRANSPORTAHON I have considered your memorandum of May 13,1999 suggesting that the staff conduct additional public meetings in Nevada on spent fuel transportation. However, you also recommended, which I strongly support, that the present schedule for the treatment of transportation issues under license renewal should be maintained. Since the public meetings you recommended would essentially have no impact on the license renewal decision, I do not support having the meetings at this time.

I recognize that theic is a need to improve communications with Nevada on transportation issres potentially associated with Yucca Mountain. However, there will be ample opportunity for Nevada to address transportation issues in both DOE's development of an Environmental

- Impact Statement (EIS) and NRC's licensing proceeding on Yucca Mountain. Nothing in the NRC's License Renewal rulemaking and associated EIS should preclude Nevada from raising any valid transportation issue in the Yucca Mountain licensing process. It would be more appropriate to hold the public meetings in Nevada when the comments from the meetings could directly influence a Commission decision.
