Dear Dr. Richards:
I am responding to your July 12,1999, letter requesting an exemption from the FY 1999 annual fee for License No. R-130. The basis for your request is that the U.S. Department of the Air Force's research reactor at McClellan Nuclear Radiation Center meets the criteria for exemption in 10 CFR 171.11(a)(2).
Based on the information you have provided, License R-130 is exempt from the FY 1999 annual fee as provided in 10 CFR 171.11(a)(2). As long as the Department of the Air Force is the licensee, you must certify annually that you meet the exemption criteria specified in 10 CFR 171.11(a)(2). We anticipate that the final FY 2000 fee rule will be published in the Federal Register in early summer,2000. That would be the appropriate time to certify that you meet the exemption criteria for FY 2000.
