NOTICE OF VIOLATION '

Dear Mr. Williams:

This refers to our April 16,1999, discussion regarding the use of radioactive material by Quality Consultants and inspections, Inc., (QCl) under Tennessee License No. R-79255-102 in the State of Missouri. We have completed our review and determined that QCl is in violation for not filing Form-241 with the NRC. ,

As you are aware,10 CFR 150, Section 150.20(a), authorizes Agreement State Licensees to use material under their Agreement State License in NRC States, e.g., Missouri, provided they file Form-241 with the appropriate regional office at least 3 days before beginning work in the NRC state. This provides the NRC an opportunity to perform an inspection of work being

. performed in the NRC state.

The violation is cited in the enclosed Notice of Violation (Notice). Based on our review of all the information concerning this case, we have concluded that your failure to file Form-241 was not wilful, and it appea'rs to be an isolated occurrence. Further, we understand that you cancelled your pending work activities in Missouri pending resolution of this issue. Therefore, no reply to this violation is required and we have no further questions regarding this matter.

As we have discussed, if you plan on cor.oucting activities in states under NRC regulatory jurisdiction, you must file Form-241 with the NRC Region ll office at the Atlanta Federal Center, 23 T85,31 Forsyth Street, S. W., Atlanta, GA,' 30303-3415.
