Dear Mr. Blue:
This is in response to Mr. Dallas Ross' letter of June 19, 1986 to Catherine Russell.
Mr. Ross requested we respond to you on requested information regarding NRC's high-level waste (HLW) program.
Mr. Ross requested any additional NRC information on the second HLW repository project.
He also requested that NRC contact the tribes or NCAI as soon as the NRC is aware of any intent by DOE to reinitiate the search for a second repository.
DOE's Secretary Herrington stated in his May 28, 1986 announcement that all site-specific work for a second HLW repository will be postponed indefinitely.
Since DOE has complete site screening responsibility for a second repository, NRC's records have been generally, to date, limited to information copies of DOE documents, copies of which can be obtained directly from 00E. We believe that any eventual affected states and Indian tribes will be notified, at the same time NRC is notified, of DOE's intent to reinitiate the search for a second repository.
Mr. Ross' letter mentioned that your tribe would like to be informed when NRC receives a license application from DOE and be informed of public hearings.
NRC's regulations (Chapter 10, Part 2, Section 2.101, of the Code of Federal Regulations) require that a Federal Register Notice (FRN) be published upon the receipt of a HLW repository license application from DOE and that this " notice of docketing will state that the Commission finds that a hearing is required in the public interest."
Interested parties will, at that time, have an opportunity to participate in the hearing process.
As a result of DOE's May 28, 1986 announcement, our division will no longer be routinely mailing HLW documents to states and Indian tribes associated with the second repository program.
For your information, below are other ways to keep abreast of NRC's activities in the HLW program.

DOE also has a toll free recording for upcoming meetings.

HLW documentation processed by this office is routinely sent to NRC's Public Document Room (POR) in Washington, DC.
In addition, material related to the Basalt Waste Isolation Project in Hanford is also routinely mailed to the Richland Public Library in Richland, Washington.
Enclosed is a brochure describing the services of NRC's PDR.
NRC also provides various subscription services for published reports, accession listings, and other documents.
