Suggested change in licensing procedure (enclosed): None Problem / Issue:
10 CFR 30.36(d)(4) requires licensees to notify the NRC when no principle activities have been conducted for a period of 24 months in any separate building or outdoor area that contains residual radioactivity such that the building is unsuitable for release in accordance with NRC requirements. Has a violation of 10 CFR 30.36(d)(4) occurred if:
(1) no principle activities have been conducted in this building or area for a period of greater than 26 months (24 months of inactivity plus 60 days to notify),
(2) the building or area is free of all residual activity, (3) the licensee has decided that they may conduct principal activities in the area in the future (4) the license has not expired, and (5) the licensee continues to conduct principal activities in other areas.

Action Required: Determine whether licensees who have released a building or outdoor area for unrestricted use must notify the NRC af ter a period of 24 months (plus 60 days) when no principal activities have been conducted in that separate building or outdoor area.
Recommended Action:
Do not require licensees who have released a building or outdoor area for unrestricted use under approved licensing procedures to notify the NRC after a period of 24 months when no principal activities have been conducted in that separate building or outdoor area. Remarks:
Broad Scope licensees routinely release facilities for unrestricted use under approved licensing procedures and without applying for an amendment. The licensee provides the NRC with their decontamination procedures including release limits for radioactive contamination during licensing, For limited scope licensees, this issue will rarely if ever come up because they cannot release their own f acilities.
This T.A.R. is submitted as a result of inspection findings. We are requesting a repsonse to this T.A.R. that is generic to similar future inspection findings.
