MINUTES: MANAGEMENT REVIEW BOARD MEETING OF JUNE 30.1999 These minutes are presented in the same general order as the items were discussed in the meeting. The attendees were as follows:

1. Convention. Frank Miraglia, Chair of the Management Review Board (MRB), convened the meeting at 1:00 p.m. Introductions of the attendees were conducted.
2. New Business. North Dakota Review introduction. Mr. James Lynch, Rill, led the Integrated Materials Performance Evaluation Program (IMPEP) team for the North Dakota review.

Mr. Lynch discussed how the review was conducted. Preliminary work included a review of North Dakota's response to the IMPEP questionnaire. The onsite review was conducted April 13-16,1999. The onsite review included an entrance interview, detailed audits of a representative sample of completed licensing actions and inspections, and follow-up discussions with staff and management.' Following the review, the team issued a draft report on May 10,1999; received North Dakota's comment letter dated June 7, 1999; and submitted a proposed final report to the MRB on June 23,1999.

Non-Common Performance indicators. Mr. Lynch led the discussion of the non-common performance indicator, Legislation and Program Elements Required for Compatibility, which is summarized in Section 4.1 of the report. The team found North Dakota's performance relative to this indicator to be " satisfactory," and made no recommendations or suggestions. The MRB agreed that North Dakota's performance for this indicator met the standard for a " satisfactory" rating.

Common Performance indicators. Mr. Lynch presented the findings regarding the common performance indicator, Response to incidents and Allegations. As discussed in Section 3.5 of the report, the team found North Dakota's performance relative to this indicator to be " satisfactory" and made no recommendations. As detailed in their June 7, I

l 1999 response to the draft IMPEP report, the RCP stated that in the future, they will immediately report all occurrences involving lost sources and then update the Nuclear Material Events Database (NMED) system as appropriate if and when the source is found. The MRB directed that the report be revised to include this commitment. The MRB agreed that North Dakota's performance met the standard for a " satisfactory" rating

Mr. Peterson presented the findings regarding the common performance indicator, Technical Quality of Licensing Actions. He summarized the findings in Section 3.4 of the report. The IMPEP team found North Dakota's performance to be " satisfactory" for this indicator and made no recommendations. Mr. Lynch stated that he believed that the licensing program was one of the State's strengths. The MRB agreed that North Dakota's performance met the standard for a " satisfactory" rating for this indicator.

l Ms. Taylor presented the findings regarding the common performance indicator, Technical Staffing and Training. Her presentation corresponded to Section 3.3 of the IMPEP report. The team found that North Dakota's performance with respect to this indicator was " satisfactory," and made two recommendations. The MRB and the team  !

l discussed the staffing level of the North Dakota program and the vulnerability of small l l programs in general. The team commented that staffing levels were only one i l contributing factor to the " unsatisfactory" rating for the common performance indicator, I l Status of Materials inspection Program. The team and the MRB discussed the recommendation involving brachytherapy training for inspectors including if the lack of training had the potential to create health and safety issues. Mr. Shaffer stated that the brachytherapy inspection he observed was adequate, and that the recommended training would be an enhancement for the inspectors. The MRB ditected that the report be revised to reflect this. The MRB agreed that North Dakota's performance met the

, standard for a " satisfactory" rating for this indicator.

l Mr. Shaffer discussed the findings for the common performance indicator, Technical

! Quality of Inspections, which are summarized in Section 3.2 of the report. The team found that North Dakota's performance on this indicator was " satisfactory," and made no recommendations. The State thanked Mr. Shaffer for the inspector accompaniments he completed prior to the on-site IMPEP review. The MRB found North Dakota's performance met the standard for a " satisfactory" rating for this indicator.

l Mr. Shaffer discussed the findings for the common performance indicator, Status of the

! Materials inspection Program. His presentation corresponded to Section 3.1 of the l lMPEP report. The review team found North Dakota's performance with respect to this indicator " unsatisfactory," and made three recomrnendations. The team commented that their recommendation of an " unsatisfactory" rating was a difficult choice. The State commented on the progress they have made in this indicator. Mr. Wangler stressed the information provided in the State's June 7,1999 response to the draft IMPEP report l including that no inspections are currently overdue past the 25% window. The MRB l 2-

[ discussed the poss!b!'ity of a " satisfactory with recommendations for improvement" rating for this indicator. The MRB stressed the actions of State management in dealing with ' >

this indicator and decided that North Dakota's performance met the standard for a

" satisfactory with recommendations for improvement" rating for this indicator.

MRB Consultation / Comments on issuance of Report. Mr. Lynch concluded, based on the discussion and direction of the MRB, that North Dakota's program was rated

" satisfactory" for all but the common performance indicator, Status of Materials Inspection Program, which received a " satisfactory with recommendations for improvement" rating. The MRB found the North Dakota program to be adequate to protect public health and safety and compatible, and declared that a follow-up review focusing on the common performance indicator, Status of Materials inspection Program, be conducted in one year. The IMPEP team and MRB agreed that the next full IMPEP ,

review for North Dakota be conducted in four years. l Comments from the State of North Dakota. Mr. Lynch extended an invitation to the State to accompany NRC inspectors in the future. The State indicated that they would be accepting that invitation in the future.

. 3. Approval of Region IV MRB Minutes. The minutes from the Region IV MRB meeting were approved.

4. Status of Remaining Reviews. Mr. Rakovan briefly reported on the status of the current and upcoming IMPEP reviews and reports.
5. Adjournment. The meeting was adjourned at approximately 2:15 p.m.
