POLICY AND GUIDANCE DIRECTIVE PG 126,
" PROCESSING OF EXEMPTIONS FOR MATERIAL LICENSEES" .
This policy and guidance directive (P&GD) (Attachment 1) provides the policy and enteria for procedures for the processing and granting of exemptions for materiallicensees. This P&GD supersedes P&GD FC 8412 Revision 2," Granting Exemptions and Special Authorizations," and P&GD FC 92-03," Exemptions from 10 CFR 35.400 for Users not currently Authorized for fridium-192 Seeds encased in Nylon Ribbon and Palladium 103 Seeds as Brachytherapy Sources." The current exemptions in P&GD FC 83-20 Revision 2; " Standard Licensing Conditions" are not included in this guidance. There is an ongoing effort to revise the Standard License Conditions and following completion of tW effort, any identified ewmptions will be incorporated int' '.his document.
This P&GD has been rewed in accordance with the Staff Requirements Memorandum dated January 29,1997, (Attachment 2) responding to SECY 96-147, " Planning for Pursuing Regulatory improvement in the Area of Exemptions Granted to Regulations " This P&GD provides guidance to ensure that reviews of exemption requests are conducted in a reasonably consistent manner, and that the granted exemption will not present undue risk to public health and safety, and is consistent with the common defense and security. Furthermore, this P&GD provides administrative prccedures for recording exemptions received, granted, and denied in the Licensing Tracking System (LTS). The LTS database is currently being modified to accommodate these required actions. Until these modifications are completed, the regions
' should continue to maintain a listing of all exemptions requested, granted, and denied. This listing, and subsequent LTS entries, will be used to identify necessary changes to the regulations.
