The NRC will conduct a two-day regulators workshop at NRC's Rockville, Maryland Headquarters on July 27-28,1999, to discuss issues relevant to 10 CFR 31.5 generally licensed devices. These issues include: (1) the current proposed rulemaking effort to establish increased control and accountability of these devices, including a registration program; and (2) Seaman Nuclear Corporation's request to distribute a generally licensed portable moisture density gauge.

A draft copy of applicable parts of a Materials Risk Study (MRS), to be considered in the evaluation of the Seaman request, is attached. Additional infoimation on the purpose and approach, as well as the strengths and weaknesses of the MRS (SECY-99-062), and the proposed rule (SECY-99-108), is available at:

The agenda for the meeting will include Agreement State compatibility, the need for equivalent enforcement between NRC and Agreement States for lost devices, and the pros and cons of establishing a national generallicense database and registration program. In addition, the workshop will provide 'or an open discussion of the proposed rulemaking, attematives to a national general licen te database and registration program, and lessons leamed from Agreement States' experience with control and accountability, or registration programs.

Comments made during the workshop will be considered in preparing the final rule. A final agenda will be distributed using the "OSP-Announcements" list server and will be posted at the OSP Web Site as soon as it is available. We are coordinating with the Organization of Agreement States (OAS) Executive Committee to identify State representatives who would attend the workshop under NRC invitational travel.
