Osgood, "Model SP 1 and SP-2 Packages," dated July 8, 1999 in our original application (reference 1) to amend NRC Certificate of Compliance 9248, Siemens Power Corporation (SPC) analyzed the use of the renamed SP-3 shipping container for fuel assemblies and fuel rods as described in paragraphs 5(b)(1)(i),5(b)(1)(ii) and 5(b)(1)(iv) of the certificate. What follows is our analysis of the SP-3 container using a more specific fuel assembly description and applying the necessary analysis to the use of polyethylene shims as requested in recent conversations.

As a result of conversations you have had with C.D. Manning of SPC regarding the information provided by SPC in references 3 and 4, SPC is amending the application for the shipping containers that were renamed as SP-3 in reference 1. Accordingly, we are submitting six copies of EMF-1563 revision 10 which incorporates the new criticality safety evaluation mentioned previously and incorporated as a revised Appendix 6H. As a result of this evaluation, SPC is requesting an amendment to Certificate of Compliance 9248 to include this 9907290172 990727 PDR ADOCK 07109248 C

'N Ms. N.L. Osgood LJM:99:085 July 27,1999 Page 2 specific fuel assembly type as a new payload category in 5(b)(1)(viii) which will be the only fuel assembly type authoritd for shipment in the SP-3.

The new fuel type which we are requesting to be added as paragraph 5(b)(1)(viii) of the certificate is as follows:

"UO fuei assemblies in a 9x9 square array with a maximum fuel cross-section of 25 2

square inches, maximum fuellength of 174 inches, and a maximum average enrichment of 4.0 w/o U-235. The nominal pellet diameter is 0.370 inch. At least the center 3x3 rod locations shall be a water channel. Each assembly must include at least eight rods with a minimum nominal gadolinia (Gd 0 ) content of 2.0 w/o in all axial regions with 2 3 enriched pellets. Additional gadolinia rod specifications are included in supplement dated July 26,1999."

In addition, a statement should be added to paragraph 7 of the certificate based on this attached evaluation and new fuel type, indicating the following:

"For the contents described in 5(b)(1)(viii), polyethylene shipping shims with a maximum of 13 volume percent polyethylene may be inserted between the rods within the fuel assemblies."

SPC is hoping to mainta'r. the schedule of shipping internationally in the SP 3 by early September of this year.
