SUBJECT:

BUILDINGS 35-1,36,45 AND " TEST TOWER LAND"- RELEASE TO UNRESTRICTED USE (TAC NO. L31175)

Dear Dr. Asmussen:

In accordance with your application dated March 9,1999, and supplemental information dated j

June 23,1999, and pursuant to Part 70 to Title 10 of the Code of Federal Regulations, Materials License SNM-696 is hereby amended to release Buildings 35-1,36,45, and " Test Tower Land" to unrestricted use.

We have reviewed your March 9 and June 23,1999, requests to remove Buildings 35-1,36,45, and " Test Tower Land" from your license and release to unrestricted use. You supported your request with the reports entitled, " Final Radiological Surveys Performed at General Atomics' Building 35-1," dated March 5,1999; " Final Radiological Surveys Performed at General Atomics' Building 36," dated February 26,1999; " Final Radiological Surveys Performed at General Atomics' Building 45," dated February 26,1999; " Final Radiological Surveys Performed l

at General Atomics' Test Tower Land," dated February 26,1999. Our review has determined l

that there is reasonable assurance that the release of these facilities for unrestricted use will not adversely affect public health and safety or the environment.

Accordingly, Safety License Condition S-1 has been revised to include the dates of l

March 9 and June 23,1999, (Building 35-1,36,45 Test Tower Land).

If, in the future, you desire to use licensed materials and conduct licensed activities in these facilities you must request a license amendment to amend your license.
