Dear Mr. Janis:

In response to your letters of April 22, 1992, to James M. Taylor and me, I am providing comments (enclosed) on the discussion summary of the Hazardous Waste Action Coalition (HWAC) meeting held on March 20, 1992.

Although the meeting focused on the management of atixed waste at Federal facilities, I found the meeting useful and informative because it allowed senior Federal officials responsible for managing and regulating mixed waste to freely discuss the issues associated with mixed waste.

Based on these discussions, the general consensus of opinion of the meeting participants appeared to be that any relief provided to Federal facilities with respect to prohibitions or restrictions on the management of mixed waste should also be extended to private-sector facilities.

NRC is committed to seeking technical and administrative solutions to issues associated with m xed waste to facilitate compliance with both NRC and Environmental Protection Agency (EPA) requirements that apply to such waste.

To this end, we will continue working with EPA and State regulatory agencies, the Department of Energy, the regulated community, and the public to identify and resolve the issues complicating the manageuent of mixed waste.

NRC encourages continued cooperation to resolve significant issues affecting mixed waste management, thereby ensuring regulatory compliance and protection of the public health and safety and the environment.
