SUBJECT:
NRC INSPECTION REPORT NO.150-00001/99-02 AND NOTICE OF
VIOLATION
Dear Mr. Cable:
This refers .to the inspection conducted on June 8,1999, at the Bechtel National, Inc. Incinerator
- located at the Army Depot, Anniston, Alabama, an area of exclusive Federaljurisdiction. The
purpose of the inspection was to determine whether activities authorized under a general license
granted by the NRC in accordance with 10 CFR 150.20 were conducted safely and in
accordance with NRC requirements. At the conclusion of the inspection, the findings were
! discussed with you.
' The inspection was limited to the activities conducted under reciprocity in accordance with
10 CFR 150.20. The inspection consisted of selective examinations of procedures and
representative records, interviews with personnel, and direct observations of licensed activities
- during _a field inspection at the Army Depot, Anniston, AL.
Based on the results of this inspection, the NRC has determined that one violation of NRC
- requirements occurred.: The violation is cited in the enclosed Notice of Violation (Notice) and
. involves the failure to file a " Report of Proposed Activities in Non-Agreement States," (NRC
- Form-241) for conducting licensed activities in an exclusive Federal jurisdiction from January
1999 to April 1999. A violation of this type is normally considered for escalated enforcement
action, as it denies the NRC an opportunity to verify that radiographic activities are being
performed safely. - However, in this case, we considered this failure to be a Severity Level IV-
.
. violation because of: (1) the overall low safety significance associated with the circumstances,
. (2) recent inspections of your activities in August 1998 and October 1998 did not identify any
other concems, and (3) you identified, promptly reported the violation to the NRC, and submitted
' Form-241.

You are required to respond to this letter and should follow the instructions specified in the
enclosed Notice when preparing your response. For your consideration and convenience, NRC
Information Notice 96-28, " SUGGESTED GUIDANCE RELATING TO DEVELOPMENT AND
,
.
LIMPLEMENTATION OF CORRECTIVE ACTION,"is enclosed. The NRC will use your
resporise, in part, to determine whether further enforcement action is necessary to ensure
compliance with regulatory requirements,
