Good afternoon, ladies and gentlemen.
3 This is an affirmation session, and we have two items 4
before us this afternoon.
5 Before I ask the Secretary to lead us through the 6
items, do any of my fellow Commissioners have any remarks to 7
make?
8 COMMISSIONER CARR:
I have one comment.
With respect 9
to SECY 87-68A, I am personally disappointed in this vote today 10 on SECY 87-68A because it will convey to the operators the 11 indication that the Commission does not believe that a totally 12 alert operator is important to plant safety.
I have discussed 13 this with numerous operators of my acquaintance, and they are 14 in unanimous agreement with me that anything which degrades any 15 sensory capability of an operator can affect performance and 16 thus impact plant safety.
17 This vote, in my opinion, sends the wrong message to ~
18 operators and to their utilities.
I intended to ask my fellow 19 Commissioners today to reconsider their votes, but since we do 20 not have all the Commissioners here I will revisit this issue 21 at a later date.
22 CHAIRMAN ZECH:
All right, any other comments?
23 COMMISSIONER BERNTHAL:
Well, I think I should just 24 comment that I don't think anybody disagrees that it's 25 essential that our operators are always in charge of all of

1 their faculties, both in terms of fitness for duty, the issue 2
of drugs and alcohol that we have confronted here some time 3
ago, and obviously in terms of staying awake and the general 4
decorum that they exhibit in the control room.
5 So as I have already indicated, I am prepared to 6
address those issues under the format of a policy statement, 7
and I think that's consistent with prior Commission actions in 8
this general area.
9 I understand that my colleague feels strongly about 10 this, but we may indeed have another forum in which we can 11 address it.
12 CHAIRMAN ZECH:
Well, I share Commissioner Carr's

13 comments, and my vote so indicates as we present our views.

14 Commissioner Roberts?
15 COMMISSIONER ROBERTS:
I don't think any of us have 16 any disagreement about the desired result of what we want.
We 17 may have differences of opinion on how to achieve it.
That's 18 all I have to say.
19 CHAIRMAN ZECH:
Sounds to me like we probably want to 20 revisit this issue some time.
21 Now are we prepared to vote, Mr. Secretary?
i 22 MR. CHILK:
As far as I am concerned, we are prepared 23 to vote.
The issue is87-68A, entitled Northern States Power 24 Company.
The Commission here is asked to act on an order which 25 completes the Commission's consideration of the issues relating

1 to an NRC Staff order dated October 20th to the Northern States 2
Power Company which directed them to show cduce why its 3
operating license should not be modified to prohibit the use of 4
radios, tapes and television sets and other audible 5
entertainment devices in the control room of Prairie Island and 6
Monticello Nuclear Facilities.
7 Commissioners Roberts, Asselstine and Bernthal have 8
approved an order which rescinds the october 20, 1986 Staff 9
order and dismisses the proceedings.
10 Chairman Zech and commissioner Carr have disapproved 11 this order.
They have provided dissenting views to be attached 12 to the order, which note that they would have allowed the
'~'y 13 proceeding to take its normal course.
14 Commissioner Asselstine, who is a member of the 15 majority, is not present.
In view of this, Chairman Zech has 16 agreed to abstain from voting in this affirmation, so that the 17 will of the majority of the Commission will be accomplished.

21 The second item, Mr. Chairman, is SECY 87-92, 22 emergency preparedness rulemaking, in which the Commission is 23 asked to approve the final rule which changes the requirement 24 for full participation offsite exercises from within one year
- l 25 to within two years of the issuance of the operating license

for full power.
2 Chairman Zech, Commissioners Roberts, Bernthal and 3
Carr have approved the rule change, as is attached to our April 4
28th memorandum.
5 Commissioner Asselstine has disapproved and provided 6
comments to be published with the rule.
