I, Donald J. Perrotti, being duly sworn, hereby state as follows.
1.
I am employed as an Emergency Preparedness Specialist, Emerfrency Preparedness Branch, Division of Radiation Protection and Emergency Preparedness, in the Office of Nuclear Reactor Regulation, U.S. Nuclear Regulatory Commission.
I have been involved in the review and evaluation of the Sealm>ok Station onsite emergency plan and emergency preparedness since January 1986, and serve as the NRC Staff's principal emergency planning reviewer for the Seabrook Station.
A statement of my professional qualifications is attached.

On April 8, 1986, Public Service Company of New IIampshire o
(New Hampshire Yankee Division) submitted to the NRC, " pursuant to 10 C.F.R. 5 50.33(g) and n.4 thereto", a document which it characterized as a " utility plan"; this document is entitled "Seabrook Station Radiological i
Emergency
Response
Plan for the Commonwealth of Massachusetts"
("Seabrook Station RERP").
This document consists of 25 volumes of plans and operating procedures for the Commonwealth of Massachusetts, six local communities located within Massachusetts portions of the o

J Seabrook plume exposure pathway emergency planning zone (EPZ), four school districts, and two host communities.
In its submittal, the Applicant requested a meeting with the NRC Staff. "to discuss the submittal and the NRC's review schedule."

In accordance with a Memorandum of Understanding between the Commission and the Federal Emergency Management Agency (FEMA), the Staff does not normally review offsite plans submitted by an applicant under 10 C.F.R. I 50.33(g), since such reviews are reserved for FEMA.
In this instance, however, I conducted a preliminary examination of the Seabrook Station RERP, in order to ascertain the nature of that document.

Based upon my preliminary examination, it appears that the Seabrook Station RERP is a copy of the draft state and local plans and procedures which had previously been prepared by the Commonwealth of Massachusetts.
To my knowledge, the Applicant made only one change to the plan prepared by the Commonwealth, in that the Applicant attached a title page to the plan bearing the legend, "Seabrook Station Radiological Emergency Response Plan For The Commonwealth of Massachusetts"; this page is stamped in bold letters, "FOR INFORMATION ONLY".

On information and belief, in the period of 1983-1986 FEMA provided technical assistance to the Commonwealth of Massachusetts in l
developing offsite emergency plans for Seabrook, pursuant to which FEMA conducted technical reviews and provided comments on draft state and
local plans.
However, a more detailed analysis of the Seabrook Station RERP would be necessary to ascertain whether this document is identical to the draft plan that was reviewed by FEMA and, if so, whether it incorporates some or all of FEMA's comments.

The Seabrook Station RERP is an extensive plan,
which identifies state and local emergency response organizations and officials who may be called upon to respond to a radiological emergency at the Seabrook facility.
The plan includes a definition of the authorities, responsibilitics and duties of State and/or local planning officials responsible for planning, ordering, and controlling public protective response measures, and is intended to be implemented by these officials.

The Seabrook Station RERP does not contain any description of the Applicant's authority, responsibility and duties in planning, ordering and controlling public protective response measures for portions of Massachusetts located within the Seabrook Station EPZ.
In other words, the Seabrook Station RERP does not contain any " compensatory" measures to be implemented in the event that the Massachusetts state and/or local governments fail to implement their respective portions of the plan.

In addition to submitting the Seabrook Station RERP to the NRC Staff for review, the Applicant transmitted two copies of the plan to FEMA.
On April 24, 1987 FEMA forwarded those copies to the NRC Staff for its " disposition", noting that the "NRC has neither requested FEMA to review these documents nor discussed time schedules or other criteria for i

Accordingly, at this time, a FEMA review of the Seabrook Station RERP is neither currently scheduled nor in progress.

I have responsibility for the revicu and evaluation of radiological emergency plans sutrnitted by reactor applicants and licensees to assure that proposed plans meet the regulatory requirements and guidance of the Conmission.
I also func-tion as a Team Leader and Tean Marber on Energency Preparedness Appraisal Teams engaged in the onsite inspection of the inplanentation phase of licensee emer-gency prograns.
I observe nuclear power plant emergency drills and exercises involving State and local goverrrnent response agencies and participate in interagency critiques.
I served as the staff's expert witness for onsite aner-gency planning during the evidentiary hearings for the Faterford 3 and Perry 1 operating licenses and for the Clinch River Breeder Reactor construction persni t.
From Decm1ber 1976 to October 1980 I was arployed at the NRC's Region II Office of Inspection and Enforcement in Atlanta, Georgia.
I was the lead inspector for Pegion II omergency planning inspections at nuclear power reactors and fuel facilities, hbr responsibilities included planning, con-ducting and docunenting inspections of licensees' emergency plans and procedures, energency facilities and equipment, emergency training, tests and drills, and coordination with offsite support agencies.
Frmi April 1977 to August 1978, I assisted my imnce"ste supervisor who served as Gairtnan of the Federal Regional Advisory Comnit 3 (RAC) in the review of State Radiological Hnergency Plans. During October 178 I assisted in the review and approval of emergency plans for two nuclear fuel facilities. During the period of March -
August, 1979, I participated in the Carmission's coverage of envirorrnental monitoring programs at 'Ihree Mile Island, where I served as Bnergency Moni-toring Team Leader; in that capacity, I was responsible for coordination with State and Federal agencies engaged in measurement and evaluation of environ-mental radioactivity levels in the vicinity of the 'BiI nuclear plant.
From 1973 to 1976, I was arployed at Florida Power and Light Cenpany's
'Ibrhey Point Nuclear Power Plant, as ficalth Physics instructor.
My duties included radiation safety training of plant personnel (general sployees and technicians), special project reports such as providing background material for management ccnment on proposed chantres to the Code of Federal Regulations, and maintaining radiation exposure records for plant personnel.
From 1953 to 1973, I served in the thited States Artuy. As a member of the U.S. Artny Engineer Reactors Group during the period 1961 - 1973, I perfortred a variety of jobs with varying degrees of responsibility se rank and experience were gained. Among my more responsible jobs were shift health physics techni-clan at the H,1-3A Naval nuclear power plant in Mhrdo, Antarctia (1965-1966),
. Senior Health Physics / Process Chenistry instructor at Ft. Belvoir, Virginia (1966-1972), and Project Officer for the El Amy nuclear power plant (1972-1973).
I received an Associate of Arts Degree from the New York State Regents.
Albany, NY, in 1973.
In addition, I attended Anny service schools including Special Nuclear Weapons Disposal and the 52-week Nuclear Power Plant Operators course.
I have corrpleted the following U.S. Public Health Service cources:

Plans For the Seabrook Nuclear Per Station his is to transmit to the Nuclear Regulatory Comission (NRC) two copies of the Seabrook Station Radiological Emergency Response Plan for the Ccmonwealth of Massachusetts. Rese copies were delivered to the Federal Emergency Kanagement Agency (FEMA) by the Public Service Company of New Hampshire, via the service list for the Seabrook Atomic Safety and Licensing Board hearing.
As you know, at the present time, NRC has neither requested FEMA to review these documents nor discussed time schedules or other criteria for such a review. Thus, we are transmitting the copies to you for your disposition.
In the future, should the NRC wish to proceed with a review of these plans, we would appreciate the opportunity to discuss the parameters, time frams, etc., for such a review, before the formal request is made.
