NRC STAFF RESPONSE TO LILCO'S MOTION TO STRIKE TESTIMONY OF FEMA WITNESSES On April 18,1987 LILCO filed its " Motion to Strike Direct Testimony of FEMA Witnesses Baldwin, Husar, and Keller Regarding the Suitability of Reception Centers"

(" Motion").

In its Motion, LILCO requested that the Licensing Board strike the portions of the FEMA testimony which referred to reception centers for special facility populations.

The basis for the Motion is that the subject of the FEMA testimony is beyond the scope of this proceeding as defined in the Licensing Board's Memorandum and Order of December 11, 1986 and the Appeal Board's remand decision, ALAB-832, 23 NRC 135 (1986).

The Staff has reviewed LILCO's Motion and attachments, and the cited material.

The Staff agrees with LILCO that the named portions of the FEMA testimony are beyond the scope of this proceeding and supports the motion to strike.
