5 MR. CHILK: We have three papers before us,

! 6 Mr. Chairman, one of which will require a vote to hold on less 7 than one week's notice. It's SECY 86-257. I wonder if I 8 could have such a. vote.

4 13 MR. CHILK The first paper is SECY 86-258, it's a 14 final rule required by the consolidated Omnibus Budget 4 15 Reconciliation Act. The Commission here is being asked to 16 approve a final rule that results in the collection of fees l 17 from licensees that approximate one-third of the NRC budget.

18 Chairman Zech, Commissioners Asselstine, Bernthal l

19 and Carr have approved the final rule subject to editorial 20 changes and modifications suggested by the chairman and j 21 Commissioners Asselstine and Carr. Commissioner Roberts has

i 23 submit for attachment to the Federal Register notice, 4

4 MR. CHILK The second item is SECY 86-254,, a 5 request for hearing on Shearon Harris Exemption Request.

6 _MR. PARLER: Mr. Chairman,.before the Commissioners 7 affirm their votes on this paper I want to give you some 8 background information. The background information does not 9 affect your affirmance of your votes on this paper but I want 10 to make sure you know about the information.

11 I have an advance copy -- it's not too legible -- of 12 a communication that the attorney general of the state of 13 North Carolina is sending to Mr. Denton --

14 COMMISSIONER BERNTHAL: Are you sure you can read 15 that, Bill? ,

16 (Laughter.) -

17 MR. PARLERt Sending to Harold Denton --

18 CHAIRMAN ZECH: Jeremiah Denton. Senator.

19 MR. PARLERt No, Harold Denton.

20 CHAIRMAN ZECH: Okay. Not Senator then.

21 MR. PARLER: No, our Director of Office of Nuclear 22 Reactor Regulations. Asking Mr. Denton not to grant the 23 exemption which Carolina Power & Light Company has requested 24 in this proceeding.

1 25 Now, Commission action on SECY 86-254 has nothing at i

1 all to do with the grant or the denial of the exemption 4 f -.

2 request. It simply has to do with -- it relates to the l

3 request of the. petitioner, one of the petitioners in that j

4 proceeding, for a hearing. So after the Commission affirms

, 5 its vote on this paper, action on the exemption remains to be

)

6 taken.

i 7 In light of the order that is going to be issued i

8 after the commission affirms its vote in SECY 86-254, I would 9 assume that if the staff believes that an exemption should be 10 granted and believes that should be done prior to the I 11 completion of Commission action on the matter, that it would l 12 consult with the Commission in advance.

13 There's another reason why I'm informing the i

14 Commission. About an hour or so ago we got a telephone call 15 from a coalition in the state of North Carolina which wanted 4 ,

l 16 to make sure that you were aware of the letter before you [

i j 17 voted on the paper.

! 18 So having said that and having advised you that I

j 19 these matters are not relevant to your affirmation of your  !

l 20 votes on the paper, I recommend that you affirm your votes.

21 MR. CHILKt This paper, Mr. Chairman, deals with a i

j 22 request from Welles Edleman and the Coalition for Alternatives

{ 23 to Shearon Harris for a hearing on a March 4, 1986 request i ,

24 from the applicant, Carolina Power & Light, for an exemption l

i 25 from the commission's requirement that a full-scale emergency

5 1 preparedness exercise be conducted within one year prior to f .

2 the issuance of the operating license for full power, and 3 prior to operation above 5 percent rated power.

4 Chairman Zach, commissioners Bernthal, Roberts and

. 5 Carr have approved an order which requests briefs from the 6 parties on whether there's any reasonable specific material 7 issue of fact to litigate in a hearing, and if there are 8 material issues of fact, the Commission will then decide 9 whether to initiate a hearing.

10 Commissioner Asselstine has disapproved, preferring 11 the refer the issue to the licensing board. Would you please 12 affirm your votes.

13 CHAIRMAN ZECH: Aye.

14 COMMISSIONER BERNTHAL: Aye.

15 COMMISSIONER ROBERTS: Aye.

16 COMMISSIONER CARRt Aye.

17 HR. CHILK The third and last item is86-257. It's 18 , again a request for a stay and review of the appeal board 19 decision in Shearon Harris. The commission here is asked to 20 respond to requests from also Welles Edleman and the 21 Conservation Council of North Carolina and Joint Intervanors 22 for a stay of all power operations authorized by the licensing 23 board; and two, a Commission review of the July 11, 1986 24 appeal board decision that denied motions to intervene and

  • 25 stay the licensing board's decision.

6 1* All Ccamissioners have approved the order denying 2 this stay and request to take review. Would you please affirm 3 your votes.
