Dear Mr. Hcyal:
The NRC staff has completed the review of Modification A007 to Cooperative Agreement No. DE-FC04-84AL20534 between the State of Oregon and the U.S. DOE, and.I am providing NRC concurrence with my signature. The language
-modification of the definition of " Remedial Action" in Article I, Paragraph K, has resolved NRC concerns regarding the potential for initiation of remedial action construction prior to receiving NRC concurrence. However, in future agreements I would recommend that the following two suggestions be considered for this same definition in item (2):

The mechanism by which the DOE, NRC and State or Indian Tribe agree to DOE performance of preliminary design work should be identified.
o The appearance that NRC has decided that DOE "should" perform preliminary design work should be avoided. The word "should" ought to be replaced by "could" or'"may".
These items have been discussed with G. Dixson of your staff on June 17, 1986.
