Dear Mr. Zech:

The purpose of this brief letter is to make an inquiry con-cerning the Commission's decision of January 9th that no low-power license be issued for the Seabrook nuclear reactor until the Com-mission decides whether evacuation plans must be submitted first.

It is my understanding that the Code of Federal Regulations (10 CFR, Part 50.47(b)), and in particular Part 50 Statements of Consideration dated September 1, 1982, require the NRC to consider certain aspects of offsite emergency preparedness prior to issu-ance of a low-power license.

Quoting from the Part 50 Statements of Consideration, "The NRC review of the licensees' onsite re-sponse mechanism would necessarily include aspects of some offsite elements, communication, notification, protection and medical organizations, and the like."

I note that a number of deficiencies cited in the 1986 Fed-eral Emergency Management Agency (FEMA) report of the Radiological Emergency Management Agency (RERA) for Seabrook were directly re-lated to offsite issaes of communication, notification and agree-ments with local agencies.

My inquiry has two parts.

Is my understanding of the rela-tionship between the Part 50 Statements of Consideration on off-site emergency preparedness and the issuance of a low-power license correct?

Have the deficiencies cited in the 1986 FEMA report been corrected?

I would appreciate a clarification on both these matters, and look forward to your response.
